Just when I thought it couldn't get any worse...
it does.
Got a call from the homeowner today. Turns out he lost the house. Greeaaat!
Absolutely FU**IN FABULOUS! So now we need to start lookin, start packin,
and find another place. At the earliest, end of March. So that's not too bad.
But ideally, we would have stayed at this place for at least one more year.
Granted, there are many things about the place we don't like. Summertime: yellowjacket
infestation. Leaking kitchen sink ( I replaced the 'faulty' hose; the leak is still there ); etc. etc. etc.
So. Maybe one of these days I can actually enjoy life again. F*CK!
P.S. Yes I am pissed. Does it show?

Similar happened to a friend of mine who rents. The owner couldn't make the payments, bank foreclosed, had to move.

In the state of NJ, if you rent and have a lease, as long as you have been paying the rent on time, they can not throw you out, even if the owner looses the house. After the lease is another story. That may or may not help you.

Rich, our lease is up; we are now going month to month.
Well, this is a long story. Started when we first got here, even.
First several days the furnace didn't work; I tried to get it working. Owner finally
realized he needed to get someone to work on it.
One month in, we get a foreclosure notice. I call the owner, he says, yeah,
he stopped paying the mortgage in January 2010. We moved in, in February 2010. So he knew this
was happening already.
Numerous problems, including a rocking toilet, leaking kitchen sink, two big willows in the tiny backyard
that attract yellowjackets, a garage door that doesn't work, facade drawers that fall off, blinds that fall down,
etc. etc. etc.
Owner tells us he can pay off the balance if worse comes to worst. When payday comes, he doesn't have the money.
I asked him at one point, what is he doing with our rent money. He says, he has to pay his child support.
Astoundingly, every time I talk to him, various times of day, I hear his kids in the background. Um... you only
pay child support, if you don't have custody of your kids. Sooo....
What *WE* think he did with the money, is use it as SEED money for his restaurant, a Golden Corral off Santa Fe drive
in Denver. He stopped paying the mortgage to support his new business.
He tells me today, that all this time, the mortgage company was processing the forms, for the wrong address. Hm...
how'd that happen? Given his track record, HE provided the wrong information.
It's okay. We considered moving this year anyway, given all the problems with this house. We would have preferred to wait
til next year, but that's okay.

you have to change things? change them to better! you will be happy after all. Life goes up and down all the time, you are not alone on this rollercoaster. You need to get down a bit to get up, hopefully more up than before.

Given all the foreclosures going on in the market at this time you might consider talking to the bank that held the mortgage and see if they will continue to rent the place to you for a period of time.... they do have to find a way to make back the money they are out.
If you think you can stomach the place to fix it up and flip it you might even try to negotiate a mortgage equal to your rental payments.
In a market like this you can get creative working with banks.
I am really sorry to hear this news froo.... it is a giant pain in the pins. I hope things work out for you soon.

Houses are cheap now. You could consider buying a smaller economical house. Not a keeper but just enough to meet your current needs. If your finances are good enough to make the payments then you end up getting it for current lower prices, investing in yourself instead of stuffing the landlord's pockets, and have options like renting it when you hopefully move to a vast mansion and selling it later when prices are higher.

I guess my question to Froo, is the Landlord holding a security deposit? You won't be seeing that unless you could put a lien on the house.

Yes, the 'wondrous entrepreneur idiot' does have a deposit. Well, actually, I am sure he
spent it on a trip to Vegas with is girlfriend/wife to be. Soo... no, he always said he could easily pay back the back mortgage payments if worse came to worst. Guess he can't put his money where his mouth is. Oh well.
He will have posession of the house, probably through March, so we are using that deposit for the March rent. If he loses posession sooner, then we will demand the deposit back. If we don't get it, we will see his ass in court.
Just gotta get it done.

Correction:
The homeowner does not own the house til the locks are changed; rather,
he owns the home til the lien 'changes hands'. So. If that happens March 1,
then we demand our deposit back. Simple.
Anyway. After a nice drinking binge and a talk with an attorney, we know
better, how to proceed.

Well some good news. The new lender posted a notice on our door, indicating the situation; we can either do month to month, or do the 'cash' option to get out by a certain date. We will be contacted within 10 days.
We've already started looking at homes for rent, making calls, packing, etc.
Moving sucks. Did it just about 1 year ago to get out here. At least this one is not cross country.

So try, I basically stopped picking up people along the side of the highway about 10 years ago, Before that it was basically an automatic. If they had the ful pack and stuff, I even tried to make sure they were better off than I got them (give them a couple of bucks, drive them as far as I could). Ok; so we found another place to live. Did the deposit, got the key.
It's in Centennial CO. We thought it was Littleton, but it's Centennial. Nice.
Packed a lot of stuff this weekend, still more to do. We can move in, after March 10.
The rent for March is adjusted accordingly. Phew.
We're really looking forward to getting this move over with. Then, hopefully,
we can live our lives. Finally.
